    • GB residents aged 18+ only.

    • Entrants must have internet access to participate.

    • Entrants must be a teacher or Head Teacher at a primary school in Great Britain which is registered on . https://www.compare-school-performance.service.gov.uk

    • The competition is open to all GB school pupils aged 8-11, whose school has been registered by their teacher/head teacher for the Wrap, Splat, Hat 2019 schools programme. It excludes L’Oréal (UK) Limited employees’ immediate families (including their children), or anyone professionally connected with the promotion.

    • ALL PRIZES WILL BE AWARDED ON CONDITION THAT WINNING SCHOOLS AGREE TO TAKE PART IN PUBLICITY REQUESTS AS APPROPRIATE. IF THIS CONDITION IS NOT MET BY THE WINNING SCHOOL/S, THE PRIZE WILL BE AWARDED TO ANOTHER ENTRANT THAT DOES AGREE TO THIS CONDITION.

  7. How to Enter Requirements

    • Entrants must already have, or must open, a valid registered account with the National Schools Partnership ("NSP") through the website found at: https://nationalschoolpartnership.com. New accounts can be created via the website https://nationalschoolspartnership.com/sign-up/

    • For registration with the NSP to be valid, entrants must provide a valid email address as part of the registration process

    • Entrants must then organise for pupils at their school to create an A4 poster telling us why they love their skin, and how it can be protected from the sun using images and words to show their amazing skin within the pupil’s individual ‘My Sun Safety Passport’ provided by the NSP that can be found via https://nationalschoolspartnership.com/initiatives/wrap-splat-hat/

    • The entry must be original material created by the pupil.

    • Entrants must receive explicit consent for a pupil to enter the competition from each pupil’s parent or guardian through completion of the Competition Entry Form found in/with ‘My Sun Safety Passport’ – accessible via: https://nationalschoolspartnership.com/initiatives/wrap-splat-hat/, before the competition end date.

    • Entrants enter on behalf of the school whose details they provide when they register with the NSP, and not in any personal capacity.

    • Entrants may only submit one entry per pupil for their school. Any entries in addition to this (such as through multiple teachers entering into the Competition on behalf of the same school) may be disqualified by the Promoter.

    •To enter, entrants submit each pupil's entry together with a completed entry form for each individual entry either by:
    (i) post: Wrap, Splat, Hat Schools Competition, We are Futures, 1 Paris Garden, Southwark, London SE1 8ND;
    (ii) email: wrapsplathat@nationalschoolspartnership.com; or
    (iii) fax: 020 7509 6651.
    The entry form can be found inside each pupil's 'My Sun Safety Passport’.

  8. Major Prize
    £1,000 worth of sports equipment for the school - to be agreed between the Promoter and the school in accordance with the recommendations of an independent expert, as to the requirements of the particular school.

  14. Judging Procedure
    The winner will be the entrant that is selected by a panel formed by We Are Futures and the Promoter as the "best" design, at their sole discretion, based on its imagination, creativity, attention to sun safety and how effectively the Wrap Splat Hat message is conveyed.

    The judging panel will pick a winner and two runners-up based on the same criteria stated above.
  15. Notification of Winner(s)

    • We Are Futures will contact the winner on the Promoter's behalf using the email address associated with the winner's NSP account by no later than 28/06/19.

    • If the winner does not respond to We Are Future's notification of winning within 7 working days of the initial contact being made, the Promoter reserves the right to select the next best entrant of those received between the competition start date and competition end date as an alternative winner.

  16. Delivery and Winner Details
  17. Prize Delivery
    Please allow up to 60 days from the date the winner acknowledging the email notification from We Are Futures. The prizes for the winner and two runner-ups will be delivered within 60 days of such acknowledgement.

    Entry and eligibility
  19. 1. The Competition will be open to all teachers and Head teachers at primary schools located in Great Britain which are registered at https://compare-school-performance.service.gov.uk. Entrants must also be legal residents of Great Britain and be aged 18 or over. The competition is open to all GB school pupils aged 8-11, whose school has been registered by their teacher/head teacher for the Wrap, Splat, Hat 2019 schools programme. It excludes L’Oréal (UK) Limited employees’ immediate families (including their children), or anyone professionally connected with the promotion.
  20. 2. Entrant registration must be received between the Entry Open Date and the Entry Closing Date and all entries must also be sent to We Are Futures by the Entry Closing Date.
  21. 3. All entrants will enter the Competition on behalf of the school at which they are employed and whose details they enter on registration through the NSP website ("Schools").
  22. 4. The Competition is free to enter and no purchase is necessary.
  23. 5. To participate, subject to an entrant complying with the How To Enter Requirements and consent from a Parent/Guardian of each pupil via completion of the Competition Entry Form (found in/with the ‘My Sun Safety Passport’), a School must submit to We Are Futures the posters explaining why they love their skin, and how it can be protected from the sun using images and words to show their amazing skin by its School's pupils in the period between the Entry Open Date and the Entry Closing Date.
  24. 6. Only one entry per pupil.
  25. 7. Any entries which do not comply with the How to Enter Requirements will be disqualified.
  26. 8. All personal details and/or information given in the entry form or otherwise must be truthful, accurate and in no way misleading.
  27. 9. Incomplete, illegal, misdirected or late entries will not be accepted. Proof of posting or sending will not be accepted as proof of receipt. Responsibility cannot be accepted for lost, damaged or delayed entries whether due to technical or connectivity problems or otherwise.

  29. Prize fulfilment and disqualification
  30. 11. The winning School will receive £1,000 worth of sports equipment for the school to be provided by the Promoter - to be agreed between the Promoter and the school in accordance with the recommendations of an independent expert, as to the requirements of the particular school.
  31. 12. The runner-up Schools will receive A Garnier goody bag containing an assortment of Garnier products.
  32. 13. The winning and runner-up Schools will be directly responsible for accounting for and paying any tax, National Insurance or other similar liabilities in respect of their prize. The Promoter will not account for any such tax, National Insurance or other similar liability arising from the Competition.
  33. 14. The entrant on behalf of the winning School will be notified through an email sent by We Are Futures to the email address provided on registration in accordance with the How To Enter Requirements, no later than 14/06/19.
  34. 15. Only the winner will be notified by email and telephone. Winners must accept their prize within 7 working days of being notified.
  35. 16. Prizes will be delivered to the winning School no later than 60 days after the winning entrant has acknowledged to the satisfaction of the Promoter the email notification sent by We Are Futures.
  36. 17. The Promoter's decision is final and no correspondence will be entered into. The Promoter is not responsible for any decisions made by We Are Futures in the allocation of the prizes.
  37. 18. Prizes are as stated, they are not transferable and there are no alternative prizes or cash substitutes. Promoter reserves the right to substitute a prize of equal or greater value in the event that the selected prize is unavailable for any reason whatsoever
  38. 19. If any prize is declined, or if any School forfeits their prize under these terms and conditions, then the Promoter will select the School on behalf of which the next best entry (in its sole discretion) is received as the alternative winner.
  39. 20. Promoter reserves the right to disqualify an entrant or winner that, in its absolute discretion, could bring Promoter into disrepute.
  40. 21. Promoter shall disqualify any entries that have failed to abide by and/or are in breach of these Terms and Conditions.
  41. 22. Neither the Promoter nor agencies involved in this promotion may be liable to the winners, whether arising from tort including negligence, breach of contract or otherwise or for any loss or damage whatsoever caused by matters relating participation in this competition, or in relation to the prizes to the extent permissible by law.
  42. 23. Any entries containing any third party intellectual property without prior informed consent from the rights holder, or abusive, inappropriate, offensive or obscene language or imagery will be disqualified. Examples of language/images considered to be inappropriate, offensive or obscene, include (but are not limited to): any message/image which contains (a) swearing; (b) comments or actions which appear to be discriminatory of any person, company or group of individuals, for example comments of a racist, sexist or homophobic nature; (c) sexual innuendo, sexual language or sexual acts, actions or gestures; (d) promoting any illegal unlawful activity such as drug use; (e) any message that appears to be an advertisement or solicitation to buy; and (f) any materials (whether written or visual) that directly or indirectly relate to Garnier Ambre Solaire competitor brands or that show any intention of promoting any brand other than Garnier Ambre Solaire.
  43. 24. The name of the winner, and runners-up can be obtained by sending a stamped, self-addressed envelope, within 4 weeks of the Judging Date to the Promoter at 255 Hammersmith Road, London, W6 8AZ, referencing the Competition Name.
  44. Promotional Activity relating to the Competition
  45. 25. In entering the Competition, all entrants and winners agree to participate in any promotional activity relating to the Competition for publicity purposes (in any media, print or online, including any websites, social media sites or third party retailer websites) and in advertising, marketing or promotional material (whether or not related to the Competition) free of charge without additional compensation or prior notice.
  46. 26. Promoter shall own all the copyright and other intellectual property rights in the entries and any other materials (whether visual, oral or written) generated during the various stages of this promotion, in perpetuity and on a worldwide basis for use at Promoter's sole discretion including, without limitation, use in advertising, other media, press releases, editorial and promotional activity, point of sale material, Promoter's websites, third party websites (including Facebook, Instagram, Twitter and YouTube), newsletters and e-newsletters.
  47. 27. Accordingly entrants assign to Promoter any copyright and other intellectual property rights which exist in their participation in this competition and irrevocably waive any moral rights that could vest in them (which shall include their name, location and age) under the Copyrights, Designs and Patents Act 1988 or otherwise, and undertake to do all things necessary immediately on Promoter’s request to effect or confirm any assignment in this paragraph.
  48. 28. Entrants' submissions, future submissions and quotes generated during any stage of the competition may be modified by the Promoter to fit in context with the content of the relevant usage, whilst maintaining the original sentiment.
  49. Personal Information
  50. 29. All personal details and/or information given in the application either in the entry process or otherwise must be truthful, accurate and in no way misleading. Promoter reserves the right to disqualify entrants if they have supplied untruthful, inaccurate or misleading personal details and/or information.
  51. 30. Any personal information that entrants share with the Promotor (including name, address, email, social media profile, or other data) will be kept secure and only used in line with Promoter’s Privacy Policy and these Terms. By entering the Competition, entrants agree that their information may be used by the Promotor and its suppliers to administer the Competition. The Promotor may contact entrants by email, post, phone, SMS or other means in relation to the Competition, but will not send entrants any marketing communication unless entrants have also agreed to this.
  52. Limitation of Liability
  53. 31. Neither Promoter nor agencies nor suppliers involved in this Competition will be liable to the winners, whether arising from tort including negligence, breach of contract or otherwise or for any damage, loss, liabilities, injury or disappointment incurred or suffered whatsoever as a result of or relating to participation in this Competition or the prizes to the extent permissible by law. No compensation for loss of earnings will be paid by Promoter for participation in any aspect of this Competition.
  54. 32. By participating in the Competition, participants agree that the prize is awarded on an "as is" basis, and that neither the Promoter nor any of its subsidiary or affiliated companies, make any representations or warranties of any nature with respect to the prizes.
  55. 33. The provision of the prizes does not imply endorsement by the Promoter of We Are Futures or any other third parties concerned in any way with this Competition. Any complaints or queries relating to the use of the prizes should be directed to We Are Futures.
  56. 34. Neither the Promoter nor any of its subsidiary or affiliated companies are responsible for any condition, circumstances, losses, failures or delays caused by events beyond its or their control such as (but not limited to) the acts or defaults of any supplier selected by the Promoter to provide the prizes or otherwise that may cause the Competition to be disrupted or corrupted, or that may lead to loss or damage of the prizes in transit to the winners.
  57. 35. Save where it has been negligent, the Promoter will not be responsible for any damage, loss or injury resulting from entrants' entry into the Competition or their acceptance and/or use of the prizes, or for technical, hardware or software failures, lost, faulty or unavailable network connections or difficulties of any kind that may limit or prohibit their ability to participate in the Competition. The Promoter will not be responsible for any lost, damaged, defaced, incomplete, illegible or otherwise unreadable entries. Nothing in these Terms and Conditions shall in any way limit the Promoter's liability for death or personal injury caused by its negligence or for any other matter where liability may not as a matter of law be limited.

This label should be affixed to boxes weighing not less than 3kg, and arrange for free pick-up by UPS. All collected plastic must be received and verified by TerraCycle® before the Competition end date.

    8. Major Prize

      • One school playground makeover up to the value of £10,000. TerraCycle® will provide five options which are available to the winner, and the winner will be invited to select their preference from these options. The manufacturer, selected by TerraCycle®, will then conduct an initial survey to confirm the suitability of the selected prize for the winner. If the survey finds that the winner's school cannot accommodate their chosen prize, the Promoter reserves the right to offer an alternative prize.

    You shall be solely responsible for the Results you create with this Application. These are entirely your choice and you have exclusive liability for any third party claims relating to the use of the Results.

    You hereby represent and warrant to us that (i) you own or have all the necessary rights and/or authorizations to use and/or upload the User Content and/or Result (ii) all information and/or User Content and/or Result you post or submit for posting is accurate and not misleading.

    We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our Application. When a breach of this policy has occurred, we may take such action as we deem appropriate, and may result in our taking all or any of the following actions:

    • Immediate, temporary or permanent withdrawal of your right to use our Application.
    • Immediate, temporary or permanent removal of any posting or material uploaded by you to our Application.
    • Issue of a warning to you.
    • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
    • Further legal action against you.
    • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
    We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

    b. License on User Content and Result

    If you choose to post your Result or User Content on the Nutrisse Club, you hereby grant to us a royalty-free, worldwide, perpetual, irrevocable, non-exclusive and sub-licensable right and license to use, edit, copy, adapt, download, distribute, modify and make derivative works from the User Content and/or Result and/or to display such User Content and/or Result and any modification or derivative work thereof within the Nutrisse Shade Finder App.

    c. Application provided models and content

    The Application may make available to you some Application Content (especially but without limitation models and content related to our cosmetic products and/or brands). You acknowledge and agree that such Application Contents are subject to intellectual property law and/or image rights and/or other proprietary rights and are made available solely within the scope of the License and in compliance with the Purpose. Therefore any reproduction and/or representation, in whole or in part, of the Application Content, or of any of the items of which they comprise, on any media whatsoever, for other purposes than expressly describe in these Terms & Conditions is expressly prohibited.

    d. User Reviews

    The Application also enables users to leave reviews. Garnier grants you a licence to use this service for your personal use in accordance with these terms. This free, non-exclusive and non-transferable licence allows you to use the review service to review the products listed on the Application and not for any other purposes. Garnier shall not be held responsible for any content created by you on the Application. You are not allowed to copy or reproduce the user review service or any other element of the Application or take any action with a view to distributing or reproducing the Application or review service or any content.

    By posting a review on this Application you represent and warrant that:

    • you are the author of the comment, that you are not stealing the identity of another person, and you are not using a false email address or otherwise being misleading as to the origin of your comment;
    • your comment is your original work and does not infringe the intellectual property rights of third parties;
    • you hereby waive all moral rights and any intellectual property rights that would have otherwise vested in you pursuant to the Copyright, Design and Patents and Act 1988;
    • all content that you post is truthful and accurate;
    • you are at least 16 years old;
    • your comment complies with these Terms of Use.
    You further agree and warrant that you shall not submit any content:

    • that consists of or contains political campaigning, commercial solicitation, chain letters, mass mailings or other forms of “spam”;
    • that is unrelated to the purpose of reviewing the products listed on the Application;
    • which contains any swearing, sexual innuendo or sexual language or which promotes or incites the perpetration of any unlawful activity such as drug-taking;
    • for which you will derive any compensated or monetary benefit by any third party or which could be construed as an advertisement or solicitation to buy (which shall include any content that directs business away from Garnier);
    • that includes any information that references other websites, URL addresses, email addresses, contact information or phone numbers;
    • that contains any actual computer viruses or other potentially disruptive or damaging computer programs or files, or , or instructions on how to create the same.
    Garnier reserves the right to change, edit or delete any comment submitted by you to its website that Garnier deems, in its sole discretion, to violate these Terms of Use. Garnier reserves the right not to publish or to remove any comment submitted by any user for any reason. In addition, it reserves the right not to publish or to remove:

    • duplicate content;
    • blank reviews;
    • reviews in a language that is not English;
    • any unintelligible content (such as content that contains random characters and meaningless word strings).
    Garnier has the right to limit or suspend access to any user that is in breach of these Terms of Use.

    Garnier cannot guarantee that you will be able to edit or delete any content you have submitted. Garnier reserves the right to remove any submission if it does not comply with these Terms of Use.

Garnier reserves the right to refer your review to its Consumer Advisory Department rather than publishing it if it believes that your comment would be better handled in this way.

    The user review service may be unavailable from time to time for maintenance or other technical reasons and Garnier cannot take any responsibility for any errors, omissions, interruptions, deletions or delays that may be experienced by users when accessing the review service.

    For any comments that you post, you grant Garnier a perpetual, irrevocable, worldwide, royalty-free, fully sub-licensable and transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and distribute such content and/or incorporate such content into any form, medium or technology, including Garnier’s social media pages, together with your username or first name and location.

    You agree to perform all further acts necessary to perfect any of the above rights granted by you to Garnier including the execution of deeds and documents, at its request.

    You agree to indemnify, keep indemnified and hold Garnier (which shall include its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers), harmless from all losses, claims, demands, and damages (actual and consequential) of every kind and nature, direct or indirect including reasonable legal fees, which are incurred by Garnier for any breach of your representations and warranties set forth above.

    Garnier reserves the right to suspend the user review at any time without notice.

    a. General provisions

    Unless provided otherwise, the products and services which are presented to you do not constitute an offer of sale but a general presentation of the range of the products and services that we distribute in the country in which this Application is available.

    c. Advice and diagnostic tools

    All the Results of the Application are only given for information and simulation purposes. We will not be held liable for any inaccuracies with the results of the Application. The information provided by the Application can in no event replace qualified professional clinical consultation, nor substitute for medical treatment or professional hair services

    In consequence, we cannot guarantee your entire satisfaction with respect to the advice that results from the use of such tools and assume no liability for the use that you may make of it.

    d. Hypertext links

    The hypertext links implemented on the Application may take you to websites published by third parties as to which we do not control the content. In consequence, and to the extent these hypertext links have been included on this Application in order to facilitate your navigation of the Internet, the consultation of such third party websites is entirely your choice and your exclusive liability.

  8. 8. Personal Data & Privacy

    We may collect your personal data, including your name, email address, other information provided when you register, and any User Content you post to the Application. We collect this information when you: (i) register to use the Applicationl; or (ii) when you upload or post User Content on the Application; or (iii) when you contact us through the Application either directly or as redirected through the Garnier.co.uk website. If you want to take photos with the Application, then you must allow access to your device’s camera. The Application will not access any of your photos or other information on your device.

    We may use your personal data in the following ways:

    • To manage your registration so that you can login and use the Application;
    • To contact you about your use of the Application, including any User Content you post. We will not contact you with any marketing unless you have separately agreed to this;
    • To respond to any contact or request from you - if you send us a message, your data is kept and used to send a response to, and manage, your request;
    Any personal data collected will be used in accordance with our Privacy Policy.

    You acknowledge and agree that you have been informed that the Application, the Application Content and/or the Result is provided “as is” and more particularly you recognize that:

    • The Use of the Application is at your sole risk;
    • We and/or our licensors provide no warranties whatsoever, including, but not limited to, those with respect to hidden defects, conformity, fitness for a particular use or purpose, and non-infringement and do not warrant that the Application, the Application Content and/or Result (i) conforms to the requirements or preferences of the User or its computer environment or its internet/telecommunication connection; (ii) is efficient, available, accurate, uninterrupted, secure, error free or without risk of error or; (iii) is free of infection by viruses, worms, Trojan horses or anything else manifesting contaminating or destructive properties, containing no material which some individuals may deem objectionable, suitable for any purpose; (iv) the Result or any subsequent results on the User whether in a professional hair salon or elsewhere will be satisfactory to you and/or meet your requirements upon the actual purchase of any products or services you deem appropriate to achieve the Result and/or will be realistic. All the Results of the Application are only given for information and simulation purposes. In no case could we be held liable for any inaccuracies with the results of the Application or quality of the hair services provided by hairdressers in partner salons or elsewhere;
    • You agree to hold harmless and indemnify Garnier, and its subsidiaries, affiliates, officers, agents, employees, advertisers, licensors, suppliers or partners from and against any claim arising from or in any way related to (a) your breach of these Terms of Use, (b) your use of the User Content, Application or the Results or (c) your violation of applicable laws, rules or regulations in connection with the User Content, Application or the Results. In such a case, we will provide you with written notice of such claim, suit or action.
    • You agree that Garnier will not be liable for any direct or indirect damages resulting from the access or use of the App, the Results or the use of the products recommended under the latter. This limitation of liability applies to L'OREAL, its subsidiaries, directors, agents, contractors, officials and employees.
  11. 11. Term and Termination

    The Terms of Use shall take effect on the date on which you have accepted them and shall remain in force throughout your use of the Application. We may withdraw the Application at any time. You agree that we shall have no liability and that the exercise of such discretionary power shall not result in any payment or compensation whatsoever to you or to any other person.

  12. 12. Waiver and Severance

    If Garnier fails to insist that you perform any of your obligations under these Terms of Use, or if Garnier does not enforce its rights against you, or it delays in doing so, that will not mean that Garnier has waived its rights against you and will not mean that you do not have to comply with these obligations. If Garnier does waive a default by you, it will only do so in writing, and that does not mean that Garnier will automatically waive any subsequent default by you.

    Each of the conditions of these TOS operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining conditions will remain in full force and effect.

  13. 13. Applicable law and attribution of jurisdiction

    These terms of use for the Application and our relationship with you shall be governed by the laws of England.

    Any proceedings in connection with or related to this Application or any dispute as to the validity, interpretation and/or performance of these terms of use shall be subject to the exclusive jurisdiction of England.

  1. The prize draw is open to all UK residents aged 18 and over, with the exception of the Promoter’s employees, their immediate families or anyone professionally connected with the promotion.
